BOOKING AND STAY TERMS — VILLAS FRÉGATE
1. Landlord and purpose
Landlord: Solange MOGADE — Villas Frégate / Au Bon Temps de Frégate. Address: Frégate Ouest 1, 97240 Le François, Martinique. SIRET: 498 299 650 00016. For enquiries or complaints, use “Contact the host” on this page or the contact details in your agreement.
Corossol, Hibiscus and Colibri are furnished villas for private holiday stays, not a principal residence. Your agreement identifies the property, facilities, dates, guests, extras and price.
2. Requests and booking confirmation
Checking availability or submitting an enquiry does not confirm a booking or trigger payment. The host checks your request and supplies the particular terms.
A booking is confirmed after acceptance of the agreement and the landlord’s verification of scheduled bank transfers, subject to availability. A scheduled transfer is not a received payment. Guests receive explicit confirmation.
An offer remains valid for 48 hours from transmission of the IBAN or payment link, as stated in the agreement. Changes to dates, property, guests or services require the landlord’s written agreement.
3. Occupancy and visitors
The number and identity of guests must match the agreement. Each villa accommodates a maximum of five people, excluding children under two; infants must still be declared and their accommodation agreed. Accommodation for a fifth guest and available beds are confirmed for the selected villa.
Additional or replacement guests and outside visitors require prior permission. The agreed number of people allowed on the premises must not be exceeded. Guests cannot add occupants unilaterally.
Assignment, subletting or making the property available to third parties, even free of charge, is prohibited without the landlord’s written consent.
4. Quiet enjoyment and no parties
Parties, festive evenings, events and gatherings are prohibited. The accommodation is intended for rest and peaceful private use.
Guests and their visitors must respect neighbours, other occupants, the garden and equipment. Noise disturbance is prohibited both day and night, including amplified music, shouting or excessive device volume. Unlawful activities are prohibited.
Use the premises and equipment according to the instructions provided on arrival. Guests are asked to stop breaches; consequences depend on their seriousness, the agreement and applicable rules. These terms do not provide for automatic forfeiture of the entire security deposit.
5. Prices, extras and tourist tax
Contract prices are in euros. The agreement states the stay price, accepted extras, discounts, payments received and balance. A discount already included must not be deducted again.
Paid extras require the guest’s agreement. Air conditioning from 9 pm to 7 am is included; unrestricted use is an optional extra charged per night and per villa at the price specified for the stay. A cot may be provided on request, subject to availability.
Any tourist tax is calculated at the applicable official rate and specified before commitment, including liable guests, amount and whether included or payable separately. Under-18s are exempt.
6. Payment and reservation deposit
Payment may be spread over one to ten interest-free bank transfers, depending on the time before arrival and the agreed schedule. The first payment is due on booking, followed by monthly or more closely spaced payments when needed. For new bookings, instalment payments must be settled at least 7 days before arrival; within 7 days, payment is due in one instalment on booking. Long-stay offers specifying advance settlement must be paid in full before arrival.
The first payment constitutes the “arrhes” reservation deposit specified in the agreement. Its amount, the instalments and any other expressly accepted payment method are stated in the particular terms. Include the full stay reference in each transfer. Bank details are supplied separately.
7. Cancellation, changes and early departure
Cancellation or change requests must be made in writing to the landlord, quoting the stay reference.
For cancellation less than 60 days before arrival, the agreed arrhes are retained, subject to statutory rights. At least 60 days before arrival, bank-transfer payments are refunded in full; for card payments accepted by the landlord, any retained bank fees must be actually incurred, disclosed in the agreement and legally permitted.
If the landlord cancels, payments received are refunded within seven days, without prejudice to other guest rights, including repayment of twice the arrhes where that rule applies.
Early departure does not entitle guests to a refund unless agreed in writing or required by law. Force majeure and mandatory rights remain subject to applicable rules.
Dated holiday accommodation does not carry a fourteen-day withdrawal right under Article L221-28(12) of the French Consumer Code. Contractual cancellation rights remain available.
8. Arrival and departure
Check-in is from 4 pm and check-out no later than 11 am, unless an exception is expressly agreed.
Confirm your expected arrival time a few days before your stay and notify the host of delays. Check-in and access instructions are provided before arrival.
9. Security deposit and inventory
A security deposit separate from rent is provided by cheque on arrival. The exact amount and any alternative agreed arrangement are stated in the individual agreement.
A joint condition report and inventory are completed on arrival and departure. Report issues promptly and any damage or incident within 24 hours of discovery. This reporting period does not remove statutory rights.
The deposit is returned on departure or within 30 days, less substantiated amounts for damage, lost keys or items, or necessary interventions attributable to the guest, excluding normal wear and tear. Deductions must be supported by evidence. The security deposit does not pay the rent.
10. Pool, garden and equipment
The landlord maintains the pool weekly, usually on Thursdays, and the garden usually on Wednesdays. Guests use the pool net during their stay and follow maintenance and safety instructions.
Do not alter Wi-Fi, air-conditioning, pool or other technical settings. Necessary intervention resulting from guest interference may be charged with supporting evidence.
Children remain under responsible adult supervision, particularly around the pool. Safety devices must not be disabled. Entry into the property for work is arranged with the guest’s consent, except for a legally justified emergency.
11. Insurance, incidents and complaints
Landlord’s insurer: MAIF. The landlord specifies the coverage applicable to the stay and any insurance required of guests; this does not guarantee coverage of every risk or personal belonging.
Report incidents, damage or problems promptly so the host can seek a solution. No term excludes liability or legal remedies that cannot lawfully be excluded.
Send complaints to the landlord in writing first. Where consumer-mediation rules apply, guests may use the competent mediator free of charge after an unresolved prior complaint. The landlord must provide the designated mediator’s contact details before conclusion of the agreement.
12. Documents, personal data and applicable law
The individual agreement states the stay-specific details and expressly accepted exceptions. Retain the terms accepted when booking with that agreement. Later website updates do not retrospectively change an existing agreement.
Personal data are processed under the website’s privacy policy. Wi-Fi credentials, bank details and private guest information are not included in these public terms.
French law applies without overriding mandatory consumer protections. If no amicable solution is reached, jurisdiction is determined under the applicable rules.
